CHILD PROTECTION, SAFEGUARDING & MEDIA CONSENT POLICY

APPLICATION SCOPE: All Community Experiences, Digital Platforms, Member Circle Portals, and Gated Cloud Media Repositories


1. PURPOSE AND STATUTORY SCOPE

The Cove & Kin LLP is committed to creating an uncompromising sanctuary for families and children. This Child Protection, Safeguarding & Media Consent Policy (“Child Protection Policy”) establishes Our mandatory operational, digital, and legal standards for safeguarding minor children (individuals under eighteen years of age).

This Policy operates in strict compliance with:

  • The Protection of Children from Sexual Offences (POCSO) Act, 2012 (specifically Section 19 mandatory statutory reporting obligations);
  • Section 9 of the Digital Personal Data Protection (DPDP) Act, 2023 (governing child personal data processing and verifiable parental consent); and
  • The Information Technology Act, 2000 (and rules framed thereunder regarding electronic child safety).

2. PHYSICAL SANCTUARY & ON-SITE CHILD SAFEGUARDING

2.1 Non-Delegable Parental Responsibility

The Cove & Kin LLP provides curated environments for family experiences. The Club does not operate as a childcare facility, school, daycare, or custodial guardian. Attending parents and legal guardians maintain sole, non-delegable responsibility for the continuous physical care, observation, supervision, and conduct of their minor children at all physical events and venues.

2.2 Venue Safeguarding Protocols

  1. Mandatory Adult Accompaniment: No minor child shall be admitted to any Event or physical venue without an authorized, attending adult parent or designated adult caregiver.
  2. Restricted Physical Access: All Event venues operate under private, gated access controls. Unverified third parties or unauthenticated non-ticketed individuals are strictly prohibited from entering event premises.
  3. Strict Camera Prohibition: As mandated under Our General Attendance Policy, participants and guests are strictly prohibited from taking photographs, videos, or digital recordings during physical events.

3. GATED MEMORY CLOUD & DIGITAL MEDIA ACCESS RULES

To allow families to preserve candid memories without compromising child privacy, The Cove & Kin maintains a proprietary, gated digital media repository (“Memory Cloud”):

3.1 Attendance-Gated Access

Access to event media folders within the Memory Cloud is strictly restricted. The platform programmatically verifies event attendance; only active Members who completed a ticket purchase and were physically checked in at that specific event are granted access to view or download that event’s official candid photographs. Unauthenticated users, applicants, non-attending members, and non-member guests have zero access to Memory Cloud media.

3.2 Professional Candid Photography Only

All media published to the Memory Cloud is captured exclusively by authorized, vetted official photographers engaged by The Club. Photographers focus on capturing of physical community bonding.

4. INTRA-COMMUNITY MEDIA CONSENT TOGGLE & NO LAW OVERRIDE CLAUSE

4.1 Profile Preference Toggle Mechanics

Inside The Circle Member Portal, active Members are provided with an intra-community photo sharing preference toggle within their household profile settings:

  • Opt-In Preference (“Yes”): The Member grants permission for event photographs featuring their child’s face to be shared by other members non-commercially.
  • Opt-Out Preference (“No”): The Member requests that others exclude their child’s face from candid background shots prior to publication.

4.2 STATUTORY NO LAW OVERRIDE CLAUSE

This profile media toggle operates strictly as a voluntary, intra-community courtesy preference governing private, gated member communications. Selecting “Yes” or “No” on this preference toggle shall not override, supersede, waive, or alter any applicable statutory laws, including the Protection of Children from Sexual Offences (POCSO) Act, 2012, Section 9 of the Digital Personal Data Protection Act, 2023, or Indian criminal jurisprudence. The Cove & Kin LLP strictly prohibits the commercial exploitation, public exposure, or unlawful processing of any minor child’s image.

5. ABSOLUTE PUBLIC SOCIAL MEDIA REDISTRIBUTION BAN

Gated Memory Cloud assets are provided exclusively for private, personal family archiving.

You are strictly prohibited from downloading, exporting, publishing, or sharing any Memory Cloud photograph or video containing the face or identifiable likeness of another Member’s minor child onto any public social media platform (including Instagram, Facebook, LinkedIn, X, TikTok, YouTube, or public personal blogs) or commercial channel.

Violation of this section constitutes a material breach of Our Club Charter and shall result in immediate, non-refundable membership revocation and potential legal action under applicable privacy laws.

6. STATUTORY INCIDENT ESCALATION & POCSO MANDATORY REPORTING PROTOCOL

6.1 Zero-Tolerance Standard

The Cove & Kin LLP maintains an absolute zero-tolerance standard for any form of child abuse, exploitation, inappropriate behavior, unauthorized photography, or boundary violations at physical venues or across digital platforms.

6.2 Mandatory Statutory POCSO Reporting

In strict compliance with Section 19 of the POCSO Act, 2012, any founder, employee, contractor, facilitator, venue staff member, or community member who receives information, observes, or holds reasonable apprehension or suspicion that a child safety violation or offense under POCSO has occurred:

  1. Must immediately report the incident to the designated Internal Safeguarding Officer (support@thecoveandkin.club); and
  2. Shall ensure immediate, mandatory reporting of the incident to the Special Juvenile Police Unit (SJPU) or local law enforcement authorities as mandated by Indian statutory law.

The Club shall fully cooperate with law enforcement and statutory authorities in any investigation involving child protection or digital privacy violations.

7. ENFORCEMENT & GOVERNING LAW

Any violation of this Child Protection Policy shall result in immediate physical ejection from venue premises, permanent digital account termination, membership forfeiture without refund, and escalation to statutory law enforcement authorities where applicable.

This Policy shall be governed by and construed in accordance with the laws of the Republic of India, subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra.
