GENERAL ATTENDANCE POLICY & EVENT WAIVER

APPLICATION SCOPE: All Live Community Experiences, Workshops, Play Sessions, Wellness Activities, Physical Venues, and Ticket Check-in Touchpoints


1. SCOPE AND BINDING WAIVER ACCEPTANCE

This General Attendance Policy & Event Waiver (“Attendance Policy”) governs participation in all physical community experiences, workshops, play sessions, wellness activities, and related gatherings (hereinafter “Event”) organized, hosted, or facilitated by The Cove & Kin LLP (“Organizer,” “The Club,” “We,” “Us,” or “Our”).

By registering for an Event, purchasing a ticket, completing an online checkout, authenticating a member profile, or executing a 1-Click Check-in Acceptance (including ticket transferees generating an entry pass), You (“Parent,” “Guardian,” “Participant,” or “You”) confirm that You have read, understood, and voluntarily accepted all provisions of this Attendance Policy on behalf of Yourself, Your spouse, and Your attending minor child(ren).

2. CONTINUOUS PARENTAL SUPERVISION & RESPONSIBILITY

2.1 Non-Delegable Supervisory Duty

The Cove & Kin LLP facilitates community experiences designed for family bonding. You expressly acknowledge and agree that You are solely and continuously responsible for the safety, supervision, conduct, and well-being of Your child(ren) throughout the entire duration of the Event.

2.2 No Childcare Services Provided

While the Organizer takes reasonable measures to plan and conduct Events responsibly in safe environments, You acknowledge that the Organizer does not provide childcare, guardianship, medical supervision, or individual monitoring of children. Your child(ren) must remain under Your continuous direct care, observation, and supervision at all times, including during structured activities, free play, venue movement, facility usage, and break periods.

3. ASSUMPTION OF INHERENT RISKS & MEDICAL DISCLOSURES

3.1 Assumption of Risk

You understand that participation in family and children’s activities involves inherent risks. These risks include, but are not limited to:

  • Slips, trips, and falls;
  • Collisions with equipment, structures, or other participants;
  • Allergic reactions, sensitivities, or exposure to environmental elements;
  • Property damage, loss, or personal discomfort; and
  • Unforeseen physical incidents or illness.

You voluntarily assume all risks associated with Your household’s participation in any Event.

3.2 Fitness to Participate & Medical Disclosures

You confirm that Your attending child(ren) and family members are physically fit to participate. You agree to disclose all known medical conditions, severe allergies, dietary sensitivities, behavioral considerations, disabilities, or special care requirements during booking or check-in.

4. STRICT VENUE CAMERA & PHOTOGRAPHY BAN

To preserve an authentic, unhurried sanctuary and protect the privacy of all attending families and minor children:

  1. Absolute Ban: Taking photographs, recording videos, or capturing digital media of any kind by participants is strictly prohibited at all Event venues.
  2. Equipment Usage: Mobile phones and cameras must remain stowed during live experiences.
  3. Prohibition of Redistribution: You shall not record, publish, stream, or broadcast images or audio of any other attending family, child, or staff member.

5. DATA CAPTURE NOTICE & SAFETY MANIFESTS

You acknowledge and agree that The Cove & Kin captures specific personal data points—including adult attendee names, child names, child dates of birth (DOBs), emergency contact information, and dietary/allergy restrictions—solely for:

  1. Formulating mandatory venue safety manifests;
  2. Ensuring age-appropriate activity grouping and safety tiers;
  3. Preparing dietary/allergy accommodations; and
  4. Executing rapid emergency coordination if required.

All captured data is handled strictly in accordance with Our Privacy Policy.

6. LIMITATION OF LIABILITY & INDEMNIFICATION

6.1 Limitation of Liability

To the maximum extent permitted under applicable law, You agree that the Organizer, its founders, partners, employees, facilitators, contractors, volunteers, venue partners, sponsors, affiliates, and representatives shall not be liable for any injury, illness, accident, loss, damage, expense, delay, theft, or claim arising from:

  • Your child’s participation in the Event;
  • Acts or omissions of other participants or third-party venue visitors;
  • Pre-existing medical conditions, allergies, or undisclosed sensitivities;
  • Circumstances beyond the reasonable control of the Organizer; or
  • Your failure to adequately supervise Your child.

This limitation of liability shall not apply in cases of proven gross negligence, fraud, or willful misconduct by the Organizer where liability cannot legally be excluded under Indian law.

6.2 Indemnification

You agree to indemnify, defend, and hold harmless the Organizer, its founders, and representatives from and against all claims, demands, liabilities, losses, damages, costs, or expenses (including legal fees) arising from Your child’s actions, Your breach of this Attendance Policy, or Your failure to supervise Your child appropriately.

7. EMERGENCY MEDICAL AUTHORIZATION

In the event of a medical emergency, You authorize the Organizer to seek basic emergency medical assistance or first responder services on behalf of Your child or family if You are unavailable, incapacitated, or unable to act immediately. You acknowledge and agree that all costs and expenses associated with such emergency medical care shall remain Your sole responsibility.

8. ENFORCEMENT, EJECTION & SINGLE APPEAL PROTOCOL

8.1 On-Site Venue Enforcement

The Cove & Kin operational team present at any Event maintains full, sole authority to enforce venue safety, behavioral standards, and the camera ban. The venue team may immediately eject any individual or household from an Event without a refund if they determine, in their sole discretion, that a breach of this Policy or a safety risk has occurred.

8.2 Single Appeal Protocol

Any Member or ticket holder subject to venue ejection or subsequent membership suspension may submit one (1) written appeal to support@thecoveandkin.club within seven (7) calendar days of the incident. The appeal will be reviewed exclusively by the Founders of The Cove & Kin LLP, whose written decision shall be final and binding.

9. GOVERNING LAW AND JURISDICTION

This Attendance Policy and Waiver shall be governed by and construed in accordance with the laws of the Republic of India. Any dispute or legal claim arising hereunder shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra, India.

10. ACKNOWLEDGEMENT & EXECUTION

By registering for an Event, purchasing a pass, accepting a transferred ticket, or scanning an entry QR code, You confirm that You are at least eighteen (18) years of age, possess full legal capacity, and voluntarily execute this Attendance Policy and Waiver for Yourself and Your household.
